ohio cottage food laws

Ohio has some of the best cottage food laws of any state. They allow operators to sell as much as they want, and the products may be sold anywhere as long as they are labeled properly.  Also, there is no registration process or fees to get started.  Although the laws were originally implemented in 2001 (making them one of the first cottage food laws in the nation), they amended the laws in 2010 to add more products to the list of allowed foods.

Interestingly, Ohio also has laws for those that want to sell refrigerated baked goods from their homes, like cheesecakes.  Those that wish to do so must apply for a home bakery license, which costs $10. (http://cottagefoods.org/laws/usa/ohio/)

Sandusky Farmer's Market vendors are required to make themselves aware of all local and state laws pertaining to the production, sale, and taxation of their goods. Check out the links below to learn more.

taxation

All merchants operating in Erie County must automatically calculate the sales tax due on each purchase made and include it separately in the receipt. Goods bought for resale or other business use may be exempted from the sales tax. Essential purchases like medicine and groceries are exempted from the sales tax or eligible for a lower sales tax rate. Erie County doesn't collect sales tax on purchases of most groceries  (http://www.tax-rates.org/ohio/erie_county_sales_tax).

Vendors are responsible for making themselves aware of the laws pertaining to the taxation of all goods they sell, and the Sandusky Farmer's Market is not responsible for any vendor who fails to do so. Check out the links below for more information.
